1. Acceptance of Terms and Eligibility

Welcome to Survivalix. These Terms of Service ("Terms") constitute a binding legal agreement between you (the "Customer," "you," or "your") and Survivalix ("we," "us," or "our") governing your access to and use of the Survivalix website located at survivalix.myshopify.com (the "Site"), and all products, services, and content made available through the Site.

By accessing, browsing, or using the Site, creating an account, placing an order, or using any services provided by Survivalix, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, all of which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site and refrain from placing orders or using our services.

Eligibility: You must be at least eighteen (18) years of age, or the age of majority in your state or jurisdiction of residence (whichever is greater), to use the Site and make purchases from Survivalix. By using the Site, you represent and warrant that you have the legal capacity and authority to enter into binding contracts under applicable law. If you are using the Site on behalf of a business, organization, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms. Survivalix reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

You may not use the Site or our services if you have previously been suspended or removed from the Site, if you are located in a jurisdiction where access is prohibited by law, or for any unlawful purpose or in violation of these Terms.

2. The Store and Products

Survivalix operates an e-commerce platform offering survival gear, preparedness equipment, outdoor supplies, and related products. All products are subject to availability. We make commercially reasonable efforts to ensure that product descriptions, specifications, images, pricing, and availability information displayed on the Site are accurate, current, and complete. However, we do not warrant or guarantee that such information is error-free, and we reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice, including after an order has been submitted.

Product images are for illustrative purposes only. Actual product appearance, color, size, and packaging may vary from images shown on the Site due to photographic lighting, screen display settings, manufacturing variations, or product updates. We are not responsible for minor variations in appearance that do not affect the functionality or quality of the product.

Product descriptions and specifications are provided by manufacturers and suppliers or compiled by Survivalix. While we strive for accuracy, we do not guarantee the completeness or accuracy of third-party information. All products sold through Survivalix are intended for lawful use only. You are solely responsible for ensuring that your purchase and use of any product complies with all applicable federal, state, and local laws and regulations. Survivalix reserves the right to refuse sale of any product to any person or entity at our sole discretion.

3. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the products in your order at the prices and on the terms then posted on the Site. All orders are subject to acceptance by Survivalix. Submission of an order does not constitute acceptance of your offer or guarantee that your order will be fulfilled.

After you submit an order, you may receive an automated order confirmation email acknowledging receipt of your order. This confirmation does not constitute our acceptance of your order; it is merely confirmation that we have received your order details. Acceptance of your order and formation of a binding contract occurs only when we process your payment and ship the products to you, or when we send you a shipping confirmation email, whichever occurs first.

Survivalix reserves the right, in our sole discretion, to refuse, cancel, or limit any order at any time for any reason, including but not limited to:

  • Product unavailability or insufficient inventory;
  • Pricing, product description, or other errors on the Site;
  • Suspected fraudulent, unauthorized, or illegal transactions;
  • Failure of payment authorization or verification;
  • Shipping or delivery restrictions or limitations;
  • Violation of these Terms or other Survivalix policies;
  • Limitations on quantities available for purchase; or
  • Any other reason determined by Survivalix in our sole discretion.

If we cancel your order after payment has been processed, we will issue a full refund to your original payment method. We may, but are not obligated to, contact you via email or phone if we cancel or limit your order.

Orders placed through the Site are generally processed within one (1) to two (2) business days. You are responsible for providing accurate, complete, and current order information, including shipping address, contact information, and payment details. Survivalix is not responsible for delays, non-delivery, or other issues caused by incorrect or incomplete information provided by you.

4. Pricing and Sales Tax

All prices displayed on the Site are in United States Dollars (USD) and are exclusive of applicable taxes unless otherwise stated. Prices are subject to change at any time without notice. We reserve the right to modify, update, or correct pricing at any time, including after an order has been placed but before it has been accepted and shipped.

In the event of a pricing error, whether on the Site, in promotional materials, or in any communication, Survivalix reserves the right to cancel any order placed at the incorrect price, even after an order confirmation has been sent. If your order is canceled due to a pricing error, we will notify you and offer you the opportunity to purchase the product at the correct price or receive a full refund.

Sales Tax: Prices shown on the Site are exclusive of sales tax. Applicable state and local sales taxes will be calculated and added to your order total at checkout based on the shipping destination address and applicable tax rates. The amount of sales tax charged will be displayed in your order summary before you complete your purchase. Survivalix collects and remits sales tax in accordance with applicable federal, state, and local tax laws, including economic nexus statutes. You are responsible for any additional taxes, duties, customs fees, or other governmental charges that may apply to your order, particularly for international shipments (if applicable).

5. Payment

Payment for all orders must be made in full at the time of purchase. Survivalix accepts payment via major credit cards, debit cards, and other payment methods as indicated at checkout. All payments are processed through secure third-party payment processors. Survivalix does not store your complete credit card or payment information on our servers.

By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method provided;
  • The payment information you provide is true, accurate, and complete;
  • Charges incurred by you will be honored by your bank or payment card issuer; and
  • You will pay all charges incurred by you at the prices in effect when such charges are incurred, including applicable taxes.

You authorize Survivalix and our payment processors to charge the payment method you provide for the total amount of your order, including product prices, shipping charges (if applicable), taxes, and any other fees. If payment authorization fails or is declined, we may suspend or cancel your order.

Survivalix uses industry-standard security measures and encryption to protect payment information. However, no method of transmission over the Internet or electronic storage is completely secure. You acknowledge and accept the inherent risks of providing payment information online.

If you believe there has been an unauthorized charge or an error in billing, you must notify us immediately at content@survivalix.shop or by calling 2624659448 so that we can investigate and resolve the issue.

6. Shipping and Delivery

Survivalix ships products to addresses within the United States. Shipping within the United States is FREE — there are no shipping costs for domestic orders. Orders are generally processed within one (1) to two (2) business days and delivered within approximately three (3) to five (5) business days for most U.S. destinations.

Delivery timeframes are estimates only and are not guaranteed. Actual delivery times may vary based on shipping carrier performance, weather conditions, holidays, order volume, shipping destination, product availability, and other factors beyond our control. Survivalix is not liable for delays in delivery caused by shipping carriers or circumstances outside our reasonable control.

You are responsible for providing a complete, accurate shipping address. Survivalix is not responsible for orders delivered to incorrect or incomplete addresses provided by you, or for delays, loss, or non-delivery resulting from address errors. If a package is returned to us due to an incorrect address, refusal of delivery, or failure to claim the package, you may be responsible for reshipping costs if you wish to have the order resent.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. Once a product has been delivered to the address you provided, Survivalix is not responsible for lost, stolen, or damaged packages. If you have concerns about delivery or package security, we recommend using a secure delivery location or requiring a signature upon delivery (if available through the carrier).

7. Returns and Refunds

Survivalix offers a 30-day return policy for eligible products. If you are not satisfied with your purchase, you may return most products within thirty (30) days of delivery for a refund or exchange, subject to the terms and conditions set forth in our Returns & Refunds Policy.

Please note that there is no statutory cooling-off period or right of withdrawal under U.S. federal law for online purchases. The 30-day return window is Survivalix's own voluntary return policy and is subject to the conditions, exclusions, and procedures detailed in our Returns & Refunds Policy.

To initiate a return, to understand which products are eligible for return, to learn about the return process, return shipping responsibilities, refund methods and timing, and any restocking fees or conditions, please refer to our Returns & Refunds Policy available on the Site.

Products must be returned in their original condition, unused, with all original packaging, tags, manuals, accessories, and components. Survivalix reserves the right to refuse returns or issue partial refunds for products that do not meet our return conditions.

8. Intellectual Property

All content, materials, features, functionality, and intellectual property available on or through the Site, including but not limited to text, graphics, logos, images, photographs, product descriptions, software, code, design, layout, user interface, audio, video, data compilations, and the "look and feel" of the Site (collectively, the "Content"), are owned by or licensed to Survivalix and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Survivalix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Survivalix or its licensors. You may not use such marks without the prior written permission of Survivalix. Other names, logos, and brands mentioned on the Site may be trademarks of their respective owners.

Subject to your compliance with these Terms, Survivalix grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and Content solely for your personal, non-commercial use and for the purpose of browsing, selecting, and purchasing products. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download (except for page caching or as necessary to view the Site), store, or transmit any Content, except as follows:

  • Your computer or mobile device may temporarily store copies of Content in RAM incidental to your access and viewing of the Site;
  • You may store files that are automatically cached by your web browser for display enhancement purposes;
  • You may print or download one copy of a reasonable number of pages of the Site for your personal, non-commercial use and not for further reproduction, publication, or distribution.

You may not:

  • Modify, copy, or create derivative works based on the Site or any Content;

Any unauthorized use of the Site or Content may violate copyright, trademark, and other laws and may result in criminal or civil penalties. Survivalix reserves all rights not expressly granted in these Terms.

9. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation;
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation;
  • To impersonate or attempt to impersonate Survivalix, a Survivalix employee, another user, or any other person or entity;
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Survivalix or users of the Site, or expose them to liability;
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site;
  • To attack the Site via a denial-of-service attack, distributed denial-of-service attack, or any other type of attack;
  • To use any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Site for any purpose without our prior written permission;
  • To harvest or collect email addresses or other contact information of other users from the Site by electronic or other means;
  • To use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site; or
  • Otherwise attempt to interfere with the proper working of the Site.

Survivalix reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting violations to law enforcement authorities, removing offending content, suspending or terminating accounts, and seeking damages and other remedies.

10. Disclaimers of Warranties

THE SITE, ALL CONTENT, PRODUCTS, SERVICES, AND MATERIALS PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND
